Spawns Gaming LLC ("Spawns," "we," "us") operates the Spawns store at store.spawnsgaming.com and the Spawns Gaming Launcher. By creating an account or buying a game, you agree to these terms.
When you buy a game on Spawns, you buy a copy of that game. Your copy is DRM-free and recorded in our ownership ledger. As long as you own it, you may download it, install it on your personal devices, and play it indefinitely. We will never remotely disable a copy you own.
You may own at most one copy of a given game per account. Your copy is yours; the game's underlying intellectual property (code, art, music, trademarks) remains the property of Spawns Gaming LLC or its licensors, and buying a copy does not grant you rights to resell mass reproductions, redistribute the files publicly, or claim authorship.
You may transfer your copy to another person. A transfer works like handing over a physical disc: you initiate an offer to the recipient's email address, and when they accept, the copy becomes theirs and your access ends, permanently and automatically. Specifically:
— Until the recipient accepts, you still own the copy and may cancel the offer.
— Once accepted, the transfer is final. We cannot reverse it, so send offers
only to people you trust and double-check the email address.
— Keeping or distributing copies of the game files after transferring your
copy is a violation of these terms and of copyright law.
— Transfers must be genuine gifts or private sales between individuals.
Operating a commercial resale business through Spawns accounts is not permitted.
If a game doesn't work or isn't what you expected, contact us at spawnsgamedev@gmail.com within 14 days of purchase and we will refund you, provided the copy is still in your account (a transferred copy cannot be refunded). Refunded copies are removed from your account. We're an independent studio and we'd rather make it right than argue.
You are responsible for keeping your password secret and your email address current — your email is how ownership offers and password resets reach you. You must be at least 13 years old (or the minimum age in your country) to create an account. We may suspend accounts that abuse the service, attempt to defraud the transfer system, or violate these terms; suspended users' owned copies remain recorded in the ledger.
We aim to keep the store, launcher, and download servers running, but we're a small studio and can't promise uninterrupted service. Because your games are DRM-free, anything you've installed keeps working even when our servers don't — including permanently, if Spawns were ever to shut down. If we ever discontinue the service, we will make reasonable efforts to give owners advance notice and a window to download their copies.
Games and services are provided "as is." To the maximum extent permitted by law, our total liability to you for any claim arising from these terms or the service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect or consequential damages, lost saves, or lost profits.
We may update these terms as the service evolves. Material changes will be announced by email or on the store before they take effect. Changes never revoke ownership of copies you already bought.
These terms are governed by the laws of the State of New York, USA, and disputes will be resolved in its courts.
